INTERNATIONAL BANK OF PANCAKESâ„ TERMS AND CONDITIONS
Effective: October 3, 2024
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY REGISTERING FOR, ACCESSING, OR USING AN INTERNATIONAL BANK OF PANCAKES ACCOUNT, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND THE IHOP TERMS OF USE, WHICH ARE INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT PARTCIPATE IN THE INTERNATIONAL BANK OF PANCAKES PROGRAM.
PLEASE BE AWARE: THESE TERMS AND CONDITIONS INCLUDE AN ARBITRATION PROVISION THAT GOVERNS ANY DISPUTES BETWEEN YOU AND US. THIS PROVISION WILL ELIMINATE YOUR RIGHT TO A TRIAL BY JURY AND SUBSTANTIALLY AFFECT YOUR RIGHTS INCLUDING PREVENTING YOU FROM BRINGING, JOINING, OR PARTICIPATING IN CLASS OR CONSOLIDATED PROCEEDINGS.
You agree that we may provide updates, notices, disclosures, and amendments to these Terms and Conditions, and other information relating to the International Bank of Pancakes program via e-mail and/or posting such information and materials on the IHOP website at www.ihop.com.
1. GENERAL TERMS; PRIVACY POLICY
These Terms and Conditions (“Terms”) apply to access to and/or participation in the International Bank of Pancakes program (the “Program") which is operated by International House of Pancakes, LLC on behalf of the IHOP franchise system (collectively, “IHOP"). These Terms are intended to supplement, and do not replace or otherwise alter in any way, the terms or conditions of any other agreement you may have with IHOP for other products and services, or the terms or conditions of any other promotional offers or programs conducted by IHOP outside the context of the Program. Personal information collected in connection with the Program is governed by IHOP’s Privacy Policy and Terms of Use, each of which is incorporated herein. Please read those items carefully to understand how IHOP collects, uses, and discloses information about customers and how to update or change your personal information and/or the ways IHOP communicates with you.
2. ELIGIBILITY
The Program is open to legal residents of the 50 United States of America and the District of Columbia who are 13 years of age or older. The Program is intended for personal use only. Commercial use is prohibited. The Program is not targeted toward, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may participate in the Program only after obtaining the permission and under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
3. JOINING THE INTERNATIONAL BANK OF PANCAKES PROGRAM
To join the Program, visit https://www.ihop.com/en/rewards (the “Website”), or the IHOP mobile app (“App”) and follow the prompts to create an account. You will be required to provide your first and last name, e-mail address, zip code, and preferred IHOP location and create a password. You have the option of providing your birthday to receive special birthday offers. If you do not provide your birthday, you will not receive any birthday offers.
4. EARNING PANCOINSSM
You will receive 1 PanCoin for every $5 spent on a qualifying purchase (as set forth in more detail below). For purposes of calculating PanCoins, your total qualifying purchases will be rounded up to the nearest dollar. Partial PanCoins will be held in 0.2 PanCoin increments. PanCoins may take up to 48 hours to appear in your PanCoin account.
PanCoins can be earned through the methods set forth below:
- You may earn PanCoins through qualifying purchases made on and after the date you register with the Program. In order to receive credit for a qualifying purchase and accumulate PanCoins, you must: (i) present the digital QR code corresponding to your International Bank of Pancakes account at the time of your dine-in purchase or (ii) enter the 13-digit code from your receipt online at www.ihop.com/en/rewards/dashboard. Receipts and/or other proof of purchase will be required for verification and troubleshooting purposes. If you are logged into your account and complete the transaction through the Website or App, you will accrue PanCoins automatically.
- You may only enter 1 receipt code per 24-hour period, and receipt codes will expire 7 days after issuance. Moreover, only 1 transaction within 24 hours will be eligible for PanCoins. For avoidance of doubt, if the first purchase was made on January 1st at noon and the second purchase was made at 6 p.m. on the same day, only one of those receipt codes will accrue PanCoins. If the noon purchase is entered for PanCoins, the next purchase eligible for PanCoins will be from a purchase made on January 2nd at noon or later.
-
To earn PanCoins, you must make a qualifying purchase in cash, a valid debit or credit card, or a valid IHOP gift card. Qualifying orders must total at least $1.00 (excluding sales tax and subject to the other exclusions set forth in the next sentence) to accumulate PanCoins. Additionally, you will not earn PanCoins on purchases of alcoholic beverages, IHOP gift cards, taxes, gratuities, donations, and fees.
5. ADDITIONAL PANCOIN EARNING OPPORTUNITIES
Birthday: On your birthday, you will receive five (5) PanCoins as a “Birthday Gift”. To qualify for a Birthday Gift, you must register for an International Bank of Pancakes account at least seven (7) days prior to your birthday and include your birthday in your account details.

12. ADDITIONAL INFORMATION; LIMITATIONS
There are no fees associated with the Program, and PanCoins are promotional.
You may only use the Program for personal use, and your account and promotional coupons may not be sold, transferred or assigned to, or shared with, family, friends, or others, or used by you for any commercial purpose. You are limited to one Program account for personal use.
Without notice to you and in our sole discretion, we reserve the right to suspend or terminate your account if we determine that you are in violation of these Terms, have otherwise engaged in unauthorized, deceptive, fraudulent, or otherwise unlawful use, or for any other reason in our sole discretion. In our sole discretion, we may suspend, terminate, or combine accounts that appear to be identical or duplicative. If your account is terminated, you will lose all PanCoins associated with your account.
IHOP is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail as a result of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any resulting error in computing qualifying purchases or any unavailability of the Program, or any injury or damage to any participant’s or any other person’s computer or mobile device related to or resulting from participation in the Program. If, for any reason, the Program is not capable of running as planned, including due to errors of any kind or nature, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of IHOP which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Program, IHOP reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Program or otherwise respond to the circumstances as IHOP deems appropriate.
13. ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS RIGHTS THAT YOU MAY OTHERWISE HAVE. IT PROVIDES FOR RESOLUTION OF MOST DISPUTES THROUGH ARBITRATION INSTEAD OF COURT TRIALS AND CLASS ACTIONS. ARBITRATION IS MORE INFORMAL THAN A LAWSUIT IN COURT, USES A NEUTRAL ARBITRATOR INSTEAD OF A JUDGE OR JURY, AND DISCOVERY IS MORE LIMITED. ARBITRATION IS FINAL AND BINDING AND SUBJECT TO ONLY VERY LIMITED REVIEW BY A COURT. THIS ARBITRATION CLAUSE SHALL SURVIVE TERMINATION OF THESE TERMS.
You agree that any claim, controversy, or dispute (whether in contract, tort, or otherwise) you may have at law or in equity against IHOP, its parent, subsidiaries, or affiliated entities, or any of their respective officers, directors, employees, or agents (all such individuals and entities collectively referred to herein as the “IHOP Entities”) arising out of or relating in any way to the Program, PanCoins or any reward, your participation in the Program, these Terms, or the scope or applicability of this agreement to arbitrate (each, a “Dispute”) will be resolved in accordance with the provisions set forth in the following paragraph.
Please read this paragraph carefully. It affects your rights and will have a substantial impact on how Disputes are resolved. You agree that whenever you have a Dispute, you will send a written notice to IHOP (“Demand”). You agree that the requirements of this paragraph will apply even to Disputes that may have arisen before you accepted these Terms. You must send the Demand to the following address: 10 West Walnut Street, 4th Floor, Pasadena, CA 91103, Attn: Legal Department. You agree that you will not take any legal action, including filing a lawsuit or demanding arbitration, until 10 business days after you send a Demand. If the disagreement stated in the Demand is not resolved to your satisfaction within such 10 business days:
- the Dispute will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted before a sole arbitrator in accordance with the AAA Consumer-Related Disputes Supplementary Procedure effective September 15, 2005 (as may be amended) and as modified by the agreement to arbitrate in this paragraph;
- this arbitration agreement is made pursuant to a transaction involving interstate commerce and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1–16;
- the arbitration shall be held in Los Angeles, California;
- the arbitrator’s decision shall be controlled by these Terms and any of the other agreements referenced herein that the applicable user may have entered into;
- the arbitrator shall apply California law, without regard to its choice of law or conflict of law rules or principles that would result in applying the law of any other jurisdiction, consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law;
- there shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only your and/or the applicable IHOP Entity’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated;
- the arbitrator shall not have the power to award punitive damages against you or any IHOP Entity;
- in the event that the administrative fees and deposits that must be paid to initiate arbitration against any IHOP Entity exceed $125 USD, and you are unable (or not required under the rules of AAA) to pay any fees and deposits that exceed this amount, IHOP agrees to pay them on your behalf, subject to ultimate allocation by the arbitrator; and
- with the exception of subpart (f) above, if any part of this arbitration provision is deemed to be invalid, unenforceable, illegal, or otherwise conflicts with the rules of AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal, or conflicting provision were not contained herein. If, however, subpart (f) is found to be invalid, unenforceable, or illegal, then the entirety of this arbitration provision shall be null and void, and neither you nor the affected IHOP Entity shall be entitled to arbitrate their dispute. If, for any reason, the AAA is unable or unwilling to conduct the arbitration, you may file your case with any national arbitration company.
